Infant and Child Emergencies
If your baby or child is experiencing any of the following, seek immediate medical care or call 911:
- difficulty breathing, choking, blue or pale skin
- a severe allergic reaction, including swelling of the face or lips or trouble breathing
- signs of dehydration, including very few wet diapers, extreme lethargy, or dry mouth
- fever in a newborn or infant as advised by your pediatrician
- repeated vomiting with lethargy
- unusual sleepiness, difficulty waking to feed, or unresponsiveness
- any other symptoms that require immediate or emergency medical attention
Do not use Goldie in place of emergency care.
Caregiver Medical and Mental Health Concerns
Goldie is not a medical provider for adults and does not provide medical, mental health, or crisis support services.
If you are experiencing physical health concerns related to feeding or postpartum recovery, or if you are experiencing emotional distress, thoughts of harming yourself or others, or any mental health crisis, seek help from a qualified healthcare professional or emergency services immediately.
Goldie is not designed to assess, diagnose, treat, or respond to medical or mental health emergencies for caregivers.
1. Introduction and Acceptance
This End User License Agreement ("EULA") governs your access to and use of the Goldie application, website, and related services (collectively, the "Application" or "Services") provided by Goldie, Inc. ("Goldie," "we," "us," or "our").
By clicking "Accept," creating an account, or using the Application or Services, you agree to be bound by this EULA. If you do not agree, do not use the Application or Services.
2. Description of Services
Goldie is a subscription-based digital application designed to provide educational, informational, and organizational support to parents and caregivers related to infant feeding and early caregiving.
The Services may include:
- conversational guidance powered by artificial intelligence
- tracking, reflection, and memory features
- educational content related to infant feeding, pumping, formula use, solids, and related caregiving topics
Goldie does not provide medical advice, diagnosis, or treatment.
3. Eligibility and Use by Caregivers
You must be at least 18 years old to create an account and use the Services.
Goldie is intended for use by parents or legal caregivers. While the Application may involve information about infants or children, accounts may only be created and used by adults. Children may not use the Application independently.
You are responsible for all activity conducted through your account and for ensuring that any information you enter about a child is accurate to the best of your knowledge.
4. No Provision of Medical Care
Goldie is not a healthcare provider, medical device, or clinical service, and does not engage in the practice of medicine.
Nothing in the Application or Services should be considered medical advice or a substitute for care from a qualified healthcare professional, including a pediatrician, lactation consultant, or registered dietitian.
The Services are designed for a broad audience and are based on generally accepted practices for typically developing infants. Babies are individuals and may have needs or considerations beyond general guidance. If your child has medical or developmental differences, feeding or growth concerns, known allergies, or any condition that may affect feeding safety, you should consult your child's healthcare providers before acting on information from the Services.
Never disregard or delay professional medical advice because of something you read or receive through Goldie.
You acknowledge and agree that decisions about infant feeding and caregiving carry inherent risks and that you are responsible for how you use information provided through the Services.
5. Artificial Intelligence and Personalization Disclosure
Goldie includes features powered by artificial intelligence.
AI-generated responses and content may be inaccurate, incomplete, outdated, or not appropriate for your specific situation. Goldie does not guarantee the accuracy, completeness, or suitability of any AI-generated output. You should use your own judgment and seek professional advice when appropriate.
Goldie may use information you provide, including past entries and conversations, to remember your preferences and context and to surface educational content that may be relevant. This personalization may include categorizing information such as age ranges, feeding methods, or general goals in order to surface broadly applicable educational information within those categories.
Category-based personalization and memory do not mean that the Services provide individualized medical advice, diagnosis, or treatment, or that any content is appropriate for your child's specific needs. You are responsible for deciding how to use the Services and when to consult a qualified healthcare professional.
Do not rely on Goldie or AI-generated content for emergency situations or critical medical decisions.
6. User Information and Privacy
Information you provide through the Application, including information about you or your child, is "User Information."
You retain ownership of your User Information. By using the Services, you grant Goldie a non-exclusive, royalty-free, worldwide license to use, process, store, and analyze User Information to operate, personalize, and improve the Services, as described in this EULA and our Privacy Policy.
Where offered, use of User Information for model improvement or training will be subject to your consent and described in the Privacy Policy.
Goldie is not a covered entity or business associate under the Health Insurance Portability and Accountability Act (HIPAA). Health-related information you provide is governed by our Privacy Policy, which may provide protections required under applicable state privacy laws.
7. Subscriptions and Fees
Certain features of the Services require a paid subscription. Subscription fees are disclosed at the time of purchase.
Subscriptions may renew automatically unless canceled in accordance with the instructions provided in the Application. Fees are non-refundable except as required by law.
Goldie may change pricing or features with reasonable notice.
8. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Goldie immediately of any unauthorized access or security breach.
9. Intellectual Property and License
Goldie owns all rights, title, and interest in the Application, Services, and all related content, software, and functionality.
Subject to your compliance with this EULA, Goldie grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.
10. Disclaimer of Warranties
The Services are provided "as is" and "as available."
To the maximum extent permitted by law, Goldie disclaims all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.
Goldie does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, Goldie will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services.
Goldie's total liability for any claim arising out of or relating to this EULA or the Services will not exceed the greater of:
- the total fees you paid to Goldie in the twelve months preceding the claim, or
- $1,000 USD.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you in full.
12. Indemnification
You agree to indemnify and hold harmless Goldie and its officers, employees, and agents from claims arising out of:
- your use of the Services
- your violation of this EULA
- your violation of applicable law
- information you provide through the Application
14. Modifications to the EULA
Goldie may update this EULA from time to time. Material changes will be communicated through the Application or other reasonable means. Continued use of the Services constitutes acceptance of the updated EULA.
15. Miscellaneous
This EULA constitutes the entire agreement between you and Goldie regarding the Services.
If any provision is found unenforceable, the remaining provisions will remain in effect.
You may not assign your rights under this EULA without Goldie's consent. Goldie may assign this EULA as part of a merger, acquisition, or sale of assets.
